These Terms of Service (the "Terms") govern access to and use of the website, inquiry forms, email communications, estimates, invoices, service orders, coordination support, consulting services, and related services provided by HeavyHaul Connect LLC ("HHC," "we," "us," or "our"). By requesting a quote, submitting shipment information, accepting an estimate, paying an invoice, signing a service order, or otherwise using our services, you agree to these Terms.
If you are using the services on behalf of a company or other organization, you represent that you are authorized to bind that company or organization to these Terms. If you do not agree, do not use the services or submit shipment information to HHC.
HHC provides transportation coordination and logistics consulting support for lawful, non-prohibited commercial freight in the United States. Our services may include reviewing shipment details, identifying potential transportation options, coordinating administrative communications, preparing service-related documentation, assisting with planning for oversized or heavy equipment movements, and providing customer support related to the coordination process.
HHC does not operate trucks, trailers, cranes, escort vehicles, warehouses, loading equipment, or other transportation equipment. HHC does not take physical possession, custody, or control of cargo. Unless a separate written agreement signed by HHC states otherwise, HHC is not the motor carrier, freight forwarder, warehouseman, bailee, insurer, customs broker, or carrier of record for any shipment.
Our role is limited to coordination and consulting support. Transportation, pickup, transit, delivery, loading, unloading, permits, escorts, and related operational work are performed by independent third-party service providers where applicable.
Payments processed through HHC's online payment tools or invoices are intended for HHC's transportation coordination, consulting, administrative, and related service fees. HHC does not use its Stripe account as a marketplace, payment facilitator, escrow service, money transmitter, or carrier payout platform.
Carrier freight charges, equipment charges, permit charges, escort charges, loading or unloading charges, and other third-party transportation charges may be quoted or discussed for planning purposes, but unless HHC provides a written invoice expressly stating otherwise, those third-party charges are separate from HHC's coordination fees and are the customer's responsibility to pay directly to the applicable third-party provider or through another approved arrangement.
HHC does not promise to collect money from a customer for the purpose of holding, routing, splitting, or distributing funds to carriers or vendors through Stripe. Any exception must be documented in writing, must comply with applicable law, and must be supported by payment processing arrangements approved for that purpose.
HHC currently provides coordination and consulting services for shipments within the United States. HHC does not currently offer international shipping coordination, customs brokerage, import/export compliance services, or cross-border logistics services unless expressly agreed in a separate written agreement signed by HHC.
You must be at least 18 years old and legally capable of entering into binding agreements. If you submit cargo or shipment information for a business, owner, consignee, consignor, dealer, auction, jobsite, or other third party, you represent that you have permission and authority to do so.
You are responsible for ensuring that your use of HHC's services, your cargo, and your shipment instructions comply with applicable federal, state, and local laws, rules, regulations, permit requirements, property access rules, and safety requirements.
Accurate information is essential for transportation coordination. You agree to provide complete and truthful information, including cargo description, make/model/serial number when applicable, dimensions, weight, condition, operability, attachments, loading method, pickup and delivery locations, site access details, contact information, preferred dates, deadlines, permit needs, and any special handling requirements.
HHC may rely on the information you provide. If information is inaccurate, incomplete, late, or misleading, pricing, availability, permits, route planning, scheduling, carrier suitability, pickup, delivery, and the feasibility of the move may change. You are responsible for additional costs, delays, failed pickup attempts, detention, layover, re-consignment, re-routing, permit revisions, cancellation fees, or other consequences caused by inaccurate or incomplete information.
Photographs, equipment specifications, title documents, purchase documents, bills of sale, auction releases, site maps, permits, or other supporting documents may be requested before HHC begins or continues coordination work.
HHC does not knowingly support or facilitate shipment of illegal, restricted, prohibited, deceptive, unsafe, or high-risk goods. HHC may decline, suspend, or terminate any request that appears to involve prohibited cargo, improper parties, false information, sanctions risk, fraud risk, safety concerns, or regulatory concerns.
Prohibited items include, without limitation: illegal goods or contraband; controlled substances; marijuana or cannabis products regardless of state law; drug paraphernalia; counterfeit or stolen goods; weapons, firearms, ammunition, explosives, fireworks, military ordnance, or restricted defense items; hazardous materials, hazardous waste, toxic substances, radioactive materials, regulated chemicals, and any cargo requiring hazardous materials handling; live animals; human remains; perishable goods requiring temperature control; currency, bullion, negotiable instruments, or stored-value products; alcohol, tobacco, nicotine, vape products, or age-restricted consumer goods; pornography or obscene materials; goods subject to sanctions, embargoes, export controls, or restricted-party rules; and any item that cannot lawfully be transported under applicable law.
Oversized, overweight, over-dimensional, inoperable, dismantled, damaged, or specialized freight is not prohibited solely because of its size or condition, but it must be accurately disclosed and may require special equipment, permits, escorts, route review, site preparation, and additional time. HHC may refuse any shipment if the cargo, route, site conditions, documentation, or customer instructions create unacceptable risk.
HHC uses a risk-based review process appropriate to a transportation coordination and consulting business. HHC may review customer identity, business information, shipment information, cargo type, origin, destination, payment behavior, documentation, and other relevant details before accepting or continuing a service request.
HHC may request additional information from customers, including legal name, business name, email, phone number if later provided, billing information, government or business identification, proof of ownership or purchase, auction releases, loading instructions, and other materials needed to evaluate legitimacy and compliance.
HHC does not knowingly do business with sanctioned persons, restricted parties, prohibited jurisdictions, or parties attempting to evade sanctions, anti-money laundering laws, export controls, transportation safety rules, or payment processor requirements. HHC may screen customers, counterparties, and shipments against publicly available sanctions or restricted-party resources when risk indicators are present.
HHC may reject service, cancel coordination, withhold further work, or report suspicious activity where required or permitted by law. HHC is not obligated to disclose internal screening criteria or risk determinations.
Quotes and estimates are based on information available at the time they are prepared. Unless expressly labeled as a binding fixed price in writing, all quotes are estimates and may change due to carrier availability, equipment availability, route restrictions, permit requirements, escort requirements, fuel costs, site conditions, delays, cargo condition, inaccurate shipment information, timing changes, or other factors outside HHC's control.
A service order, invoice, payment request, or written email confirmation may identify the specific coordination services, fee structure, expected timeline, and any known assumptions. HHC is not required to begin work until required information is received and any required fees are paid.
Unless otherwise stated in writing, HHC coordination and consulting fees are due immediately upon invoice issuance. HHC may require payment before beginning or continuing coordination work.
HHC fees compensate HHC for time, review, planning, administrative support, communications, coordination efforts, and related consulting work. HHC fees are separate from any charges imposed by carriers, permit services, escort providers, loading providers, unloading providers, storage providers, tow services, or other third-party vendors.
You agree to pay all invoices when due and authorize HHC or its payment processor to process approved payments. You are responsible for bank fees, card fees where permitted by law, failed payment fees, chargeback costs, collection costs, and reasonable attorney's fees incurred in collecting unpaid amounts.
HHC coordination and consulting fees are non-refundable once coordination work begins. Coordination work may include reviewing shipment details, communicating with the customer, researching transportation options, contacting carriers or vendors, preparing documentation, reviewing route or permit issues, scheduling, or performing other administrative or consulting tasks.
Before coordination work begins, HHC may consider refund requests on a case-by-case basis, less any payment processing fees, administrative time, or costs already incurred. HHC is not responsible for non-refundable costs imposed by third-party providers.
Cancellations, rescheduling, changes in cargo, changes in origin or destination, unavailable contacts, inaccessible sites, equipment not ready for pickup, or missing documents may result in additional fees or third-party charges.
HHC may identify, communicate with, or coordinate with independent third-party transportation providers or related vendors. Third-party providers are independent businesses and are not employees, agents, partners, joint venturers, or representatives of HHC unless expressly stated in a written agreement signed by HHC.
HHC may consider factors such as equipment type, route, timing, apparent licensing, insurance information, service history, and availability. However, HHC does not guarantee the performance, safety, licensing status, insurance coverage, financial condition, regulatory compliance, or conduct of any third-party provider.
The customer acknowledges that transportation operations are performed by third parties and may be governed by separate documents, including a carrier confirmation, bill of lading, tariff, rate confirmation, terms and conditions, or insurance policy.
The customer is responsible for ensuring that cargo is available, accessible, accurately described, legally transportable, and ready for pickup at the scheduled time. The customer must ensure that authorized personnel are available at pickup and delivery locations, that loading and unloading equipment is suitable and available where required, and that sites can safely accommodate transportation equipment.
Unless expressly agreed in writing, HHC does not provide loading, unloading, rigging, crane, forklift, towing, storage, dismantling, assembly, tarping, packaging, crating, blocking, bracing, or cargo securement services. Any such services must be arranged separately with qualified providers.
The customer is responsible for providing safe access, accurate directions, gate codes, site rules, appointment requirements, and contact details. Failed pickup or delivery due to site issues may result in additional fees.
Oversized, overweight, or over-dimensional transportation may require permits, pilot cars, escorts, route surveys, police escorts, utility coordination, travel restrictions, daylight movement rules, weather restrictions, or other compliance steps. Requirements vary by state, route, cargo, equipment, and timing.
HHC may assist with coordination or administrative review related to these requirements, but HHC does not guarantee that permits will be issued, that routes will remain available, that government agencies will approve movement, or that third-party permit or escort providers will perform as expected.
The customer must disclose accurate dimensions, weights, axle information when applicable, and cargo configuration. Incorrect measurements may cause permit denials, enforcement issues, route changes, delays, fines, or additional costs.
Transportation coordination and heavy haul movement are subject to delays caused by weather, road closures, permitting delays, inspections, law enforcement restrictions, equipment breakdowns, labor shortages, accidents, site access problems, documentation issues, acts of God, civil unrest, government actions, cyber incidents, payment issues, or other events beyond HHC's reasonable control.
HHC may provide estimated timelines, but pickup and delivery dates are not guaranteed unless expressly guaranteed in a written agreement signed by HHC. HHC is not liable for delay-related losses, including lost profits, lost sales, project delays, rental costs, downtime, penalties, or consequential damages.
HHC does not insure cargo and does not assume carrier liability for cargo loss, damage, delay, theft, shortage, or non-delivery. Any cargo claim must be directed to the responsible carrier or applicable insurance provider, subject to the carrier's governing documents and applicable law.
HHC may request proof of insurance or related information from third-party providers when appropriate, but HHC does not guarantee that a provider's insurance will cover a specific loss, that coverage limits are adequate, or that a claim will be paid.
Customers are encouraged to obtain their own cargo, equipment, inland marine, project, or other insurance coverage as appropriate for the value and risk of the shipment.
If you believe an invoice or charge is incorrect, you agree to contact HHC promptly at info@heavyhaulconnect.com before initiating a chargeback or payment dispute. HHC will review the issue in good faith.
Improper chargebacks, payment reversals, fraudulent payments, false shipment information, or misuse of payment tools may result in suspension of services, collection activity, cancellation of coordination work, and reporting to payment processors or authorities where appropriate.
All website content, branding, text, designs, service descriptions, documents, templates, logos, graphics, and other materials made available by HHC are owned by HHC or its licensors and are protected by applicable intellectual property laws. You may not copy, resell, scrape, republish, or misuse HHC materials without written permission.
You may not use the website or services to submit false information, interfere with security, introduce malware, attempt unauthorized access, impersonate another person, or engage in fraudulent or unlawful activity.
HHC may communicate with customers by email and other business communication methods. You agree that email communications may be used for quotes, service updates, invoices, document requests, and notices.
Business information, shipment details, quotes, carrier information, and documentation exchanged during coordination may be confidential. Each party agrees to use reasonable care to protect non-public information and to use it only for legitimate business purposes, legal compliance, payment processing, or service delivery.
The services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, HHC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and uninterrupted service.
HHC does not warrant that a specific carrier or vendor will be available, that a shipment will move by a particular date, that permits will be approved, that a route will remain available, that third-party providers will perform without error, or that cargo will be delivered without loss or damage.
To the fullest extent permitted by law, HHC's total liability arising out of or related to the services, these Terms, any invoice, any service order, any website use, or any coordination activity will not exceed the amount of HHC coordination fees actually paid by the customer to HHC for the specific service giving rise to the claim.
HHC will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages, including lost profits, business interruption, project delay, loss of use, replacement transportation, rental costs, penalties, or reputational harm, even if HHC has been advised of the possibility of such damages.
Nothing in these Terms limits liability that cannot be limited under applicable law.
You agree to defend, indemnify, and hold harmless HHC and its owners, members, managers, officers, employees, contractors, and representatives from and against claims, damages, losses, liabilities, fines, penalties, costs, and expenses, including reasonable attorney's fees, arising out of or related to: your cargo; inaccurate or incomplete information; your instructions; prohibited or unlawful items; site conditions; loading or unloading; your breach of these Terms; your violation of law; payment disputes; or claims by third parties related to your shipment or use of the services.
HHC may suspend, decline, or terminate services at any time if HHC believes that a request involves prohibited cargo, sanctions risk, fraud risk, nonpayment, unsafe conditions, false information, abusive conduct, regulatory concerns, or any other unacceptable risk. Termination does not relieve the customer of payment obligations for work already performed or costs already incurred.
These Terms and any dispute arising out of or related to HHC's services are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles.
Before filing any claim, the parties agree to attempt in good faith to resolve the dispute through written notice and business-level discussion. Unless applicable law requires otherwise, any lawsuit or legal proceeding must be filed in a court of competent jurisdiction located in Wyoming. The parties consent to personal jurisdiction and venue in those courts.
HHC may update these Terms from time to time. The updated version will be effective when posted or otherwise provided, unless a later effective date is stated. Continued use of the services after updated Terms are posted or provided constitutes acceptance of the updated Terms.
